Third-party funding involves an outside party financing the costs of legal proceedings in return for remuneration from their proceeds. The types of entities that use third-party funding range from large corporations, banks and insurance companies protecting their balance sheets, to small- and medium-sized companies levelling the playing field with larger competitors, to financially distressed companies that may otherwise be unable to pursue a claim.

The funding and management of enforcement proceedings is a distinct discipline which requires more experience and skill on the part of the funder, including the capability to conduct global asset tracing and cross-border legal enforcement. As a consequence, to enhance the chances of success, the role of the funder is not just to provide capital, but also to provide these additional services. Depending on the client’s requirements, the funding can take the form of (partial) monetisation of the judgment, award, NPL or claim.
